On May 24, 2011, Jose Baez made good on his promise to deliver bombshell information during defense opening statements in the Casey Anthony trial. After lead prosecutor Linda Drane Burdick gave a detailed timeline of events the state of Florida believes transpired from June 16, 2008 until Caylee Anthony’s remains were found on December 11, 2008, lead defense attorney Jose Baez delivered his statements and included revelatory information alleging that Casey Anthony was sexually abused by her father, George Anthony, since the age of eight and added that Caylee Anthony was not murdered, but rather drowned in the family swimming pool.

The court had taken a recess then Jose Baez addressed the court, specifically mentioning to the jury how jury selection had taken place in Tampa Bay due to the “onslaught of publicity that lasted three years.” Jury selection concluded on Friday, May 20, 2011 and today marks the first day of the trial. Jose Baez referred to Linda Drane Burdick’s opening statements and timeline by pointing out that no one has told exactly what happened to Caylee Anthony. Facing the jury, Jose Baez stated, “No one told you what happened, but today, you will be the first people to know exactly what happened to Caylee Marie Anthony.”

Jose Baez also told the jury and court that he would discuss Roy Kronk, the investigation into Caylee Anthony’s murder and disappearance and the focus that was placed on Casey Anthony. Describing the investigation as comprehensive and thorough, Jose Baez stated that it was likely the most thorough investigation in Florida’s history; however, he pointed out that there were never any other suspects in the case. Jose Baez also spoke about the location where Caylee Anthony’s remains were located in December 2008: Suburban Drive. Approximately 15 houses away from the Anthony home, Jose Baez addressed the suspicious circumstances that surround how Caylee Anthony’s remains were found. Also addressed was Casey Anthony’s car, the white Pontiac Sunbird that was retrieved from a towing lot by Cindy and George Anthony. Jose Baez said there was a significant lack of evidence dealing with the car and theorized it may prolong the trial as the state and defense sort out the issues involved.

Bringing the jury’s focus to his main, bombshell point, Jose Baez stated that they were in court for one thing, and one thing only: To find out exactly how Caylee Anthony died. Jose Baez stated, “This is not a murder case. This is not a manslaughter case. This is not a case of aggravated child abuse. It is none of those things.”
Encouraging the jury to remain focused on the key issues, how Caylee Anthony died, Jose Baez continued. “How in the world can a mother wait 30 days before ever reporting her child missing? That’s insane. That’s bizarre. Something’s just not right about that. The answer is actually relatively simple; she was never missing. “
“Caylee Anthony died June 16th 2008 when she drowned in her family’ swimming pool.” Jose Baez spoke about how common it is in Florida to see children lose their lives by drowning. It was his next statements, however, that were given to back up the unfolding of events that transpired over the next six months. Jose Baez alleged that Casey Anthony came from a dysfunctional family, one in which she was sexually abused since she was eight years old, and had learned to lie. He continued speaking to the jury, “You will hear about ugly things, secret things, things that people don’t speak about. Things that Casey never spoke about.” At this point in the defense’s statements, Casey Anthony became visibly upset and wiped tears from her face.
Jose Baez stated, “On June 16, 2008, after Caylee died, Casey did what she’s been doing all her life, or for most of it; hiding her pain. Going into that dark corner and pretending that she does not live in the situation that she’s living in.” He also stated that Casey Anthony was an excellent mother who took wonderful care of Caylee and that the evidence will show there was no prior abuse involving Casey. Jose then spoke about the sexual abuse and said, “You see, this family must keep its secrets quiet.”
